From the first day of Donald Trump’s second presidential term, the administration has been offering a plan to protect the country from an invasion. Executive Order 14159, issued on the day of Trump’s second inauguration, frames America as a country under siege by illegal immigrants, many of whom, it said, “present significant threats to national security and public safety, committing vile and heinous acts against innocent Americans.” The invaders, the order insisted, intended to engage in “espionage, economic espionage, and preparations for terror-related activities.” To this end, the order instructed the Department of Homeland Security (DHS) and the attorney general…
According to reports, Kannon Shanmugam dropped out of arguing T.M. v. University of Maryland Medical System Corporation to focus on arguing Cisco Systems v. Doe. As things turned out, Elizabeth Prelogar subbed in for T.M., but lost the pro bono case. And Kannon won, big league. Cisco will be pleased. Cisco is a major case that effectively slams the door shut on possible liability under the Alien Torts Statute. Businesses will no longer need to decide between providing lucrative settlements or rolling the dice on devastating litigation. But even more importantly, this ruling sends a clear signal to lower courts,…
The Senate passed on Tuesday a concurrent resolution directing the president to cease military action in Iran or seek congressional approval by a 50–48 vote. The House passed the same resolution earlier this month. Four Republicans crossed the aisle to support the resolution: Senators Rand Paul (KY), Susan Collins (ME), Lisa Murkowski (AK), and Bill Cassidy (LA), who was recently primaried by a Trump-endorsed candidate. Senator John Fetterman (PA) was the only Democrat to vote against the resolution in the senate. Another day, another unfortunate decision by the U.S. Supreme Court that shields rights-violating government agents from facing accountability. No, I am not referring to a new case about qualified immunity, the judge-made doctrine that makes it hard to sue a bad cop for a constitutional violation. And no, I am also not referring to the line of cases involving so-called Bivens immunity, which have made it even harder to sue an abusive federal officer for a constitutional violation. I am referring here instead to the ability to sue a prison guard for a religious liberty violation under the terms of…
Freddie Ponton21st Century Wire Most people outside France still have no idea what BlackCore is. They do not know that in March 2026 a company no one had ever heard of walked into French municipal elections, ran a professional smear operation against left‑wing, pro‑Palestinian candidates, then tried to erase its own existence as soon as investigators got close. They do not know that BlackCore is not a troll farm or a couple of rogue consultants, but the marketing name on an industrial influence machine built out of Israeli military intelligence alumni, a Tel Aviv law office, UK shell companies, a London server…
Last week in United States v. Hemani, the Supreme Court unanimously ruled that the government may not strip people of their Second Amendment rights or prosecute them for illegal gun possession simply because they are marijuana users. Justice Clarence Thomas, the longest-serving current member of the Court, joined his colleagues in upholding the Second Amendment rights of cannabis consumers threatened with prosecution under 18 USC 922(g)(3), which makes it a felony for an “unlawful user” of “any controlled substance” to possess a firearm. But Thomas perceived another constitutional problem with that law, arguing that it exceeds the federal government’s power to…
Few things have been subject to as much syrupy sentimentality as the home. Those walls often hold more than any other structure: loved ones, growing pains, milestones, memories of the living and the dead. For a lot of Americans, they also hold something else: their life savings, in the form of equity. What happens when that’s effectively vaporized overnight by the government? Thousands of people across the U.S. confront a version of this question each year. They are now closer to an answer: The Supreme Court on Tuesday ruled that when the government seizes someone’s house to satisfy a property…
NA In my last post, I outlined some of the many reasons why today’s Supreme Court decision in Pung v. Isabella County, allowing below-market value compensation for tax foreclosure takings is wrong. The Takings Clause of the Fifth Amendment requires “just compensation” and giving owners far less than the property’s fair market value doesn’t measure up. Here, I add an additional point: The problem with fair market value compensation is not that it is too much, but that – all too often – it is actually too little. This isn’t just my idiosyncratic view. It’s a common criticism of current…
