As I noted in a separate post, the legal advocacy group Neutral Principles engaged Erik Jaffe and me to draft an amicus brief for them in Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County, which the Court will hear this Fall. You can read the PDF, but here is the Foreign Commerce Clause analysis (the First Amendment analysis is excerpted here):The power to “regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes” U.S. Const. art. I, § 8, cl. 3, is one of the “legislative Powers” that the Constitution “grant[s],” and promises…
Jeffrey Wernick on America’s Founding Principles, Foreign Entanglements and the Moral Cost of Empire
Invoking George Washington, John Quincy Adams and the American abolitionist tradition, Jeffrey Wernick argues that permanent foreign attachments and endless war have pushed the United States far from the values it claims to defend. Joshua Scheer Jeffrey Wernick delivers a sweeping and deeply provocative meditation on American foreign policy, arguing that the United States has abandoned the very principles its founders warned were essential to preserving the republic. Drawing on George Washington’s farewell address and John Quincy Adams’ warning that America “goes not abroad in search of monsters to destroy,” Wernick contends that modern U.S. policy has become defined…
If there is one job that no Austrian Economist will take up at this juncture, it would be that of the Federal Reserve Chair. The road ahead seems to be set in stone, and in a society that has been sold the idea that “printing currency units is a panacea to all problems” for nearly 45 years, doing the opposite is an invitation to get lynched. It is near certain that Kevin Warsh would go down in history as the Fed Chair who presided over the demise of the dollar. Perhaps as infamous as Gideon Gono, who presided over the…

The legal advocacy group Neutral Principles engaged Erik Jaffe and me to draft an amicus brief for them in Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County, which will be heard by the Supreme Court in the Fall; I much enjoyed working on it with Erik, and thought I’d pass it along. You can read the PDF, but here are some excerpts from the First Amendment analysis; I’ll blog separately about the Foreign Commerce Clause analysis.SUMMARY OF ARGUMENT Trying to avoid federal preemption, plaintiffs in this and other climate-change cases have shifted from claims targeting emissions to claims…
Chris Hedges Report In the United States, but also around the world, fascism is on the rise again, similar to what occurred in Germany and Italy after World War I. Its foot soldiers in the US include right wing extremists who enter the military, where they are welcomed and encouraged, for empowerment and training. The current Trump administration, includes Christian Nationalists, such as Pete Hegseth who heads the Pentagon, and openly supports fascist and Zionist leaders — Javier Milei in Argentina, Benjamin Netanyahu in Israel, to name a few. To understand the rise of neo-Nazis in the US military…
Grizzly Bear. The Buffalohorn and Porcupine drainages contain some of the best grizzly habitat outside of Yellowstone NP. Photo by George Wuerthner. The Greater Yellowstone Coalition (GYC) has a new TV ad advocating support for the Greater Yellowstone Conservation and Recreation Act. The Act would designate wilderness for a portion of the Gallatin Range, south of Bozeman. Still, it would significantly REDUCE the potential wilderness protection for the Gallatin Range and almost assuredly increase recreational use of these mountains. The Gallatin Range is a spectacular glaciated mountain range that runs south from Bozeman to Yellowstone National Park. These mountains are…

Juan Cole Informed Comment The Ember energy think tank reports the numbers for China’s green energy exports this spring and they are mind-blowing. The Hormuz energy crisis is having predictable effects. In March, China exported 68 gigawatts of solar panels, twice what it did in February and an all-time high. By a lot. That’s one month of exports, and it equals all the solar panel capacity ever installed in Spain — which is no slouch when it comes to solar energy. Of that, 10 gigawatts went to Africa and 39 GW to Asia, which is, again, a record in both instances.…
