Jerome Powell most likely has his last meeting as Fed Chair this week. Kevin Warsh, Trump’s pick, will likely have been approved as chair by the Senate in time for the Fed’s next meeting in June. We don’t know yet whether this will be Powell’s last meeting, since his term as a Fed governor doesn’t end until 2028. While the norm has been for chairs to step down completely from the Fed when their term as chair ends, Powell has indicated that he may stay on until Trump’s absurd criminal investigation of the Fed over building cost overruns has finally…

Yesterday a panel of the U.S. Court of Appeals for the First Circuit stayed a district court injunction, pending appeal, that would have commandeered New Hampshire by requiring it to maintain a vehicle emissions inspection program to comply with the federal Clean Air Act. As I explained here and here, the court’s order violated the anti-commandeering doctrine (though the state had not made much effort to make this argument). The unsigned order (on behalf of Chief Judge Barron and Judges Aframe and Dunlap) concluded (correctly) that New Hampshire was likely to prevail on the merits, even if it did not…

In the run-up to the 2024 election, Donald Trump promised, “We will close the border. We will stop the invasion of illegals into our country.” A year later, it was a promise he claimed to have kept. But exactly who are the “illegals”? Loose definitions and manipulated statistics tell a very misleading story about migrants from Latin America. Earlier this year, a chart appeared on social media sites like X claiming that during President Biden’s four years in office, 8% of Nicaragua’s population entered the US illegally. The chart displayed comparable percentages for five other Latin American countries — Cuba,…

Florida’s Republican-controlled Legislature approved a new congressional map that could help the GOP flip four seats in the midterm elections.  State Democrats say the map, put forward by Gov. Ron DeSantis, conflicts with Florida’s Fair Districts amendment prohibiting drawing districts with partisan intent. DeSantis has offered several reasons for the changes, including population growth.  Florida House Democratic Leader Fentrice Driskell, D-Tampa, went further, saying after the April 29 vote that it was not only illegal on a state level, but also federal. “Even if Fair Districts falls, you still have general principles of map drawing, and you still have, under…

It has been a very busy 48 hours for Louisiana. On Wednesday, the Supreme Court decided Callais. The following day, the Governor announced he would suspend the upcoming primary elections to allow the legislature to redistrict. There is also litigation before the Supreme Court about the issuance of the judgment in Callais. Earlier today, the Governor was sued to enjoin the cancellation of the election. And just a few moments ago, the Fifth Circuit panel granted a stay in Louisiana’s challenge to the mifepristone telemedicine approval from 2023. What, you thought the case was over after Alliance for Hippocratic Medicine? You…

Introduction Satellite analysis conducted by BBC Verify has confirmed the extensive destruction of civilian infrastructure in southern Lebanon since Israel launched a ground offensive on March 2. The BBC reported on April 16 that its visual verification found more than 1,400 buildings destroyed in the first six weeks of the conflict [1]. The true scale of destruction is likely much higher due to limited access on the ground, the report stated. The pattern of destruction, concentrated in villages such as Taybeh, indicates a methodical approach to leveling civilian areas [2]. Israeli officials have previously stated an intent to apply tactics used in…
